GIF It! Terms of Service

These Terms of Service (“Terms”) govern your purchase and use of GIF It! (the “Product”), a Photoshop plugin offered by Made in the Mountains Photo (“we,” “us,” or “our”). By purchasing, downloading, or using GIF It!, you agree to these Terms. If you do not agree,  do not purchase or use GIF It!.

1. Nature of the Product

GIF It! is a digital product, delivered electronically as downloadable software. No physical goods are shipped as part of your purchase.

2. System Requirements

GIF It! is a plugin for Adobe Photoshop and requires:

• A licensed copy of Adobe Photoshop, obtained through an active Adobe Creative Cloud subscription
• A Windows or Mac computer that meets Adobe’s current system requirements for running Photoshop

GIF It! does not function as a standalone application; it requires an existing, active Photoshop installation. Because Photoshop’s own requirements are set and updated by Adobe, please refer to Adobe’s current published system requirements for Photoshop to confirm compatibility with your computer before purchasing.

3. License Grant

When you purchase GIF It!, we grant you a limited, non-exclusive, non-transferable license to use the plugin for your own personal or business use, in accordance with these Terms.

This license does not include the right to:

• Share, sell, lend, sublicense, rent, or otherwise transfer GIF It!, your license, or your login/access credentials to any other person or business
• Distribute, publish, or make GIF It! (or any part of it) available to others, whether for free or for payment
• Use GIF It! on behalf of, or to provide services to, more than one photography business, unless you have purchased a license that specifically permits this
• Claim authorship or ownership of GIF It! itself, or resell it as your own

Each license is issued to a single user for use within a single photography or creative business. If you need to use GIF It! across multiple businesses or team members, please contact us about licensing options before purchasing, rather than sharing a single license.

4. Permitted Use

You may use GIF It! to edit and deliver your own creative work to your own clients, and for your own personal and professional projects. Output you create using GIF It! (such as finished GIFs and videos) is yours to use, share, and sell as part of your business, without restriction.

5. Prohibited Use

In addition to the license restrictions above, you agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of GIF It!
• Modify, copy, or create derivative products based on GIF It! for the purpose of distribution or resale
• Use GIF It! for any unlawful purpose

6. Payment and Access

Payment is due in full at the time of purchase unless otherwise stated. Upon successful payment, you will receive access to download GIF It via the Adobe Marketplace Exchange and Creative Cloud.

7. No Refund Policy

All sales of GIF It! are final. Because GIF It! is a digital product that is delivered electronically and can be accessed, downloaded, or used immediately upon purchase, we do not offer refunds, exchanges, or cancellations once a purchase is complete, except where required by applicable law.

By completing your purchase, you acknowledge and agree that:

• You are purchasing a digital product, not a physical good
• Once delivered or made accessible, GIF It! cannot be “returned” in the way a physical item can
• You have reviewed the product description, previews, and any available information prior to purchase

If you experience a technical issue that prevents you from accessing or using GIF It! as intended (such as a defective download or a plugin that will not install), please contact us at christine.madeux@gmail.com. We want GIF It! to work for you, and we will do what we reasonably can to resolve technical problems, even though this policy does not guarantee a refund.

8. Intellectual Property Rights

GIF It!, including its underlying software, branding, and any accompanying guides or materials, is the intellectual property of Made in the Mountains Photo and is protected by applicable copyright and intellectual property laws. Purchasing GIF It! grants you a license to use it under these Terms; it does not transfer ownership of the underlying intellectual property to you.

9. Updates and Support

We may, at our discretion, release updates, bug fixes, or improvements to GIF It!. We do not guarantee ongoing updates or support for any specific length of time. Where we do offer support, it is limited to helping you use GIF It! as intended; it does not extend to custom modifications or unsupported use cases.

10. Disclaimer of Warranties

GIF It! is provided “as is” and “as available.” While we make reasonable efforts to ensure it functions as described, we do not guarantee that it will be error-free, uninterrupted, or compatible with every system configuration. You are responsible for reviewing system requirements before purchasing.

11. Limitation of Liability

To the fullest extent permitted by law, Made in the Mountains Photo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, GIF It!, including but not limited to lost time, lost profits, or data loss.

12. Termination

We reserve the right to revoke your access to GIF It! if these Terms are violated, including in cases of unauthorized sharing, distribution, or resale of a licensed copy.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of GIF It! after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Germany, without regard to its conflict of law principles.
